Elder Law / Long Term Care
Elder Law involves representing, counseling and assisting seniors, people with disabilities and their families in areas such as estate planning, long-term care with an emphasis on promoting a high quality of life. Typically, needs are addressed from a perspective of medical, financial, social, family and legal issues.
Specifically, as in Elder Law attorney, after listening to their worries, fears and concerns, helping them understand the best possible solutions; not only the ones they thought of but others as well. Together we then craft a plan to give them the peace of mind they desire.
Often they receive that peace of mind after plans are prepared that handle such issues as Long-term Care, Asset Protection, Estate Planning, Wills, Advance Health Care Directive, Durable Power of Attorney for Property and Pre-need Planning.
Today, with more of the population needing long-term care, the question of how to pay for that care is a concern to many families. Generally, payment is made in one of three ways:
- Long-term Care Insurance
- Self-paid
- Medicaid
If you are close to the age where you will need long-term care, it is most likely too late to purchase long term care insurance. The cost of long-term care can exceed $5000 per month, which will very quickly deplete your resources. However, once your resources are depleted, then you can obtain Medicaid.
As an Elder Law attorney, I can assist you in repositioning your assets so that you not only qualify for Medicaid before you have spent all your monies but also protect assets so that they are not subject to Medicaid recovery. This service will mean that your children will receive a greater inheritance and you will receive much-needed assistance.
